Many people have done it successfully and I know this from personal experience.The actual regulations state “An application for initial admission, change of status or extension of stay in E-3 classification, however, may not be denied solely on the basis of an approved request for permanent labor certification or a filed or approved immigrant visa preference petition.” So this basically means they can’t deny an E-3 visa application just because you have an open Green Card application.Yes you have to demostrate residency abroad but that does not preclude you from applying and anyone that tells you differently is giving you incorrect information.CJ
